SERVICES RELATED TO TECHNICAL STANDARDS
“Technical Standards” refers to various arrangements set for related people such as developers and producers, including users in a particular technique to uniformly treat the technique and fairly obtain benefits and conveniences of the technique.
Known technical standards include those related to wireless communication technologies (3G, 4G, 5G), digital terrestrial television broadcasting, and various other technologies.
The essential patent evaluation service determines whether or not a patent invention is essential to a target technical standard. The patent determined as essential is referred to as a SEP (Standard Essential Patent). The essential patent evaluation service is generally performed by neutral evaluators.
For many years, our president has been active at the forefront of the services related to technical standards as an evaluator in organizations such as the Japan Intellectual Property Arbitration Center and IPEC (International Patent Evaluation Consortium). Other patent attorneys in our firm have also been active in the field by assisting our president.
Our president is going to be appointed as the general manager of the Japan Standard Essential Patent Support Center (JSEP Center) which is scheduled to be established shortly.
Brief Guidance
Services related to technical standards include the following.
1. Acquiring patents in view of standardization
When obtaining a patent (standard essential patent: SEP) in view of a technical standard to comply with this technique standard, we must strategically acquire protection before the technical standard is established or revised.
2. Evaluating SEPs
In this process, a patent invention is determined as either essential or inessential to the target technical standard. This process includes either performing evaluation on the SEP or receiving evaluation on the SEP.
3. Training on SEPs includes the following.
1) Training on the relationship between patents and technical standards
2) Training on how to evaluate SEPs
This training is either for performing evaluation or for receiving evaluation.
4. Other services related to SEPs
Other services include consultation related to SEPs.
